Defense Wins in Georgia Dental Liability Case

A Fulton County, Georgia, jury declined to hold a dentist liable for what a patient claimed were permanent jaw injuries she suffered during more than seven hours of dental work.

Lead defense attorney John Hall Jr. said the plaintiff, Tracy Dennis, claimed more than $200,000 in medical bills and provided expert testimony that she would need further surgeries in the future. There was no dispute that Dennis' jaw damage was genuine, Hall said, but the jury didn't believe his client had done anything wrong in treating her.

"The jury decided the case fully on the standard of care; they never even got to any of the causation questions that were a big part of the case," said Hall.

Hall said Dennis's attorney had asked the jury to award $8.1 million in damages.
